1. Independent Contractor Only

You acknowledge that you are acting as an independent contractor and are not an employee, partner, agent, representative, or joint venturer of TMG Industrial or any of its affiliates. Submitting this form or your listing does not create any employment, agency, partnership, or joint venture relationship with TMG.

2. No Obligation for TMG to List or Promote You

TMG may, at its sole discretion:

list or not list your information, highlight it, modify it, or delete it at any time;
decide where, how, and if it will be displayed;
list multiple installers in the same region.

TMG is not obligated to list you or maintain your listing, and no customer referrals are guaranteed.

3. No Liability Between Parties

TMG does not participate in your activities concerning:

communications with customers;
quotes, rates, or commitments;
planning, installation methods, or quality of execution;
safety practices, equipment used, or job site conditions;
payments, collections, disputes, or service outcomes.

All agreements are made strictly between you and the customer.

To the fullest extent permitted by law, TMG assumes no responsibility for your work, acts, omissions, performance, statements, safety practices, or warranties, nor for any direct, indirect, incidental, or consequential loss, damage, injury, or delay related to the services you provide.

4. No Endorsement or Recommendation

A listing does not mean that TMG recommends, endorses, approves, guarantees, or certifies your services, skills, insurance, or the quality of your work. Customers may choose the installer of their choice or assemble the products themselves.

5. Accuracy of Your Information and Responsibility Therefor

You confirm that all information you provide—including regarding your permits, insurance, service area, rates, and contact information—is accurate and up-to-date.

TMG is not obligated to verify or monitor this information.

You agree to promptly notify TMG of any changes to this information.

6. Authorization to Use Your Name, Logo, and Information

By submitting this form, you authorize TMG Industrial to use:

your company name
your logo
your service area information
your rate description
your contact information

in the following media:

TMG websites
social media
printed or digital materials
customer information tools
installer maps or directories
internal and external communications regarding installer choices

TMG may make minor modifications for clarity or formatting purposes.

7. Non-Exclusive Listing

Listings are non-exclusive.

TMG may list multiple installers in the same region and does not guarantee the number of potential customers, visibility, or priority.

8. Applicable Products

This listing applies only to installation services related to TMG Industrial structures, including shelters, sheds, and greenhouses.

9. Data Usage, Consent, and Retention

If you are based in or serve customers in Europe or the United Kingdom, the following provisions apply:

Your data will be used solely to process your application and, if approved, to display your information as an installer.
You may request the removal of your information or withdraw your consent at any time.
Your information may be stored in TMG systems located in Canada or the United States.
Data is retained only for the duration necessary for the listing or to meet legal obligations.
Your data will not be sold or disclosed to unrelated third parties, but it may be made public if you are listed.

10. Responsibility for Legal and Regulatory Compliance

You are solely responsible for complying with all applicable laws, regulations, permit and insurance requirements, and safety standards in your area of operation.

TMG does not verify your compliance with legal requirements.
